Our platform integrates with third-party services including Supabase for authentication, Polar.sh for payments, Plausible for analytics, PostHog for product analytics, and AI services for smart reply generation.

4. Platform Access and Usage

4.1 Account Registration

• Create an account using your email address and secure password
• Connect your X (Twitter) account for data access and analytics
• Choose a subscription plan that meets your needs
• Complete payment setup through Polar.sh

4.2 Platform Features

• Access to analytics dashboard and insights
• Use of AI-powered smart reply generation tools
• Content scheduling and management features
• Real-time support and platform updates

4.3 Data Processing

Your X account data is processed securely through Supabase for authentication and storage, with analytics provided by Plausible and PostHog. AI features may process your content through third-party AI providers.

5. Payment Terms

5.1 Subscription Pricing and Payment

• All prices are quoted in USD, the specific taxes may be included based on your localization
• Subscription fees are billed monthly or annually based on your chosen plan
• Payment is processed automatically through Polar.sh on your billing cycle
• You can upgrade, downgrade, or cancel your subscription at any time
• Changes to your subscription will take effect at the next billing cycle

5.2 Ongoing Platform Support

Your subscription includes ongoing platform support:

• Platform Updates: Regular feature updates and improvements included in your subscription
• Technical Support: Email support for platform-related issues and questions
• Data Backup: Secure backup of your account data and analytics
• Feature Access: Access to new features as they are released

5.3 Refund Policy

Refunds are available under the following conditions:

• Service Interruption: If our platform is unavailable for more than 24 consecutive hours due to our fault
• Platform Defects: If core platform features fail to function as advertised
• Time Limit: Refund requests must be made within 30 days of the billing period
• Pro-rated Refunds: For cancelled subscriptions, refunds will be calculated based on unused time
• Processing: Approved refunds are processed within 5-10 business days
• Exclusions: No refunds for usage-based charges or third-party service fees

You agree to:

• Maintain the security of your account credentials and notify us of any breaches

You retain ownership of your content and data:

• Your X posts, analytics data, and user-generated content remain yours
• You grant us a license to process your data for platform functionality

7.3 AI-Generated Content

Content generated by our AI features:

• You own the AI-generated content you create using our platform
• You are responsible for reviewing and approving AI-generated content before use
• We do not claim ownership of your AI-generated content

Our platform integrates with third-party services (Supabase, Polar.sh, Plausible, PostHog, AI providers) whose intellectual property rights are governed by their respective terms of service.

Our AI-powered features have limitations:

• AI-generated content may not always be accurate or appropriate
• You are responsible for reviewing and approving all AI-generated content
• AI services may be temporarily unavailable due to third-party issues
• We do not guarantee the quality or appropriateness of AI-generated responses

8.3 General Disclaimers

EXCEPT AS EXPRESSLY STATED, ALL SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the platform will be error-free, uninterrupted, or meet all your business requirements. Platform availability depends on third-party services and internet connectivity.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID FOR YOUR SUBSCRIPTION IN THE PREVIOUS 12 MONTHS
• WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE SHALL NOT BE LIABLE FOR LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION
• THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY OF LIABILITY

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of our platform and services
• Your violation of these Terms
• Your violation of applicable laws or regulations
• Any data or content you provide that infringes third-party rights

11. Confidentiality

We will not disclose your personal information, account data, or content to third parties without your written consent, except as required by law or as described in our Privacy Policy.

12. Force Majeure

Neither party shall be liable for delays or failures in performance due to circumstances beyond their reasonable control, including natural disasters, government actions, internet outages, or other force majeure events.

13. Termination

13.1 Termination by User

You may cancel your subscription at any time through your account settings. Cancellation terms:

• Cancellation takes effect at the end of your current billing period
• You retain access to the platform until the end of your paid period
• No refunds for partial periods unless specified in our refund policy

13.2 Termination by Company

We may suspend or terminate your account immediately if you:

• Fail to pay subscription fees
• Breach these Terms
• Provide false or misleading information
• Use our services for illegal or harmful purposes
• Violate X's terms of service or platform policies
• Abuse AI features or generate inappropriate content

14. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

1. Good faith negotiation between the parties
2. If negotiation fails, binding arbitration under Polish arbitration rules
3. The arbitration shall be conducted in Wrocław, Poland, in the English language

Each party shall bear their own costs unless the arbitrator decides otherwise.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland. Any legal proceedings shall be subject to the exclusive jurisdiction of Polish courts.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified Terms.

For active subscriptions, existing terms will remain in effect until your subscription ends.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between the parties and supersede all prior negotiations, representations, or agreements.
